  1. North Carolina has taken some drastic steps to try and retain officials. Would these steps work in Indiana? I don’t think so. But I’d like to hear what others think. Then, I’ll tell you why I don’t think it will work in Indiana under our present system.   4. Kraft issues an unconditional denial that there was “any illegal act.” The cops say they have a video of “the acts.” Who’s telling the truth? Actually, they might both be. A sex act with a consenting adult is not illegal. It only becomes a crime when there is payment, or promise of payment, for the sex act. So, unless the payment or offer of payment is also on video, as opposed to the act alone, the defense will be “I paid for a massage, and the sex was gratuitous.” If the posted price for a massage was, for example, $60, and they can show he paid $250. Well, that’s quite a tip. But if it’s just Kraft’s word against that of the masseuse, who is undoubtedly going to testify as part of a deal with the prosecution, it becomes a credibility contest.
  5. That would make sense, since the basis of the crime is the unnecessary diversion of police resources in investigating a crime that didn’t happen. Felonies generally require more resources to investigate than misdemeanors.
  6. I confess that I am not as conversant with the Illinois criminal code as I could be, since I practice civil litigation in Indiana. Still, I believe they will ultimately negotiate this down to a guilty plea on something else (what that might be, I don’t know ... yet), and he’ll get a fine and probation ... plus a ton of bad pub.

You decide if what he’s accused of merits felony status: § 26-1.  Disorderly conduct. (a) A person commits disorderly conduct when he or she knowingly: (4) Transmits or causes to be transmitted in any manner to any peace officer, public officer or public employee a report to the effect that an offense will be committed, is being committed, or has been committed, knowing at the time of the transmission that there is no reasonable ground for believing that the offense will be committed, is being committed, or has been committed; A violation of subsection (a)(2), (a)(3.5), (a)(4), (a)(6), (a)(7), or (a)(9) of this Section is a Class 4 felony.

  10. It’s an “upcharge,” a very common prosecutorial tactic that is applied to criminal defendants of all colors. It’ll be pled down to a misdemeanor and he’ll get probation. Book it.
  11. I once represented Nike in a product liability lawsuit in federal court. A local doctor ruptured an Achilles tendon playing pickup basketball, and claimed that the Air Jordan was defectively designed. Needless to say, Nike was willing to spend an awful lot of $$ to defend that claim. I’ll be interested to see if there’s any blowback on Nike for this incident. My advice: if Nike stock takes a hit because of this, buy all you can.
  12. There’s a reason why Gavit is 32-60 this decade, playing against a very, very weak schedule. The shambles that is the School City of Hammond’s athletic program mirrors the conditions of the schools themselves. Consolidation will help. But until there’s a different philosophy and commitment at the administration level, it won’t change significantly. Why would an experienced, competent coach be interested in a program that might be gone in a year or two?

  14. Per Chicago TV news tonight, Mr. Smollett is now considered “a suspect in a criminal investigation.” You can’t make this stuff up.
  15. In a rare (these days) 9-0 opinion, SCOTUS has struck down Indiana’s civil forfeiture statute. Haven’t read the opinion yet. But I knew @Muda69 would be pleased to hear this.

  17. It only needs to be on one guy ... to make that call. But the problem is, that’s not the only call that’s being made out there. That’s why it’s so difficult with a 5 man crew. Give us 7, and the odds of catching it go way up. Of course, we don’t have enough qualified officials in the state to cover varsity games with 7 ... or even 6.
  18. What on earth does most of this discussion have to do with the NFHS universally adopting the 40 sec. play clock? If we're going to discuss the rules changes from a philosophical standpoint, I'd much rather discuss the possibility of the IHSAA implementing some form of replay for the state finals.
  19. No, because it is not required field equipment under either the NF or the IHSAA rules. Still not getting your point. My observation was that virtually every school in Indiana has them, from the biggest to the smallest. So the financial "burden" is obviously not much of a burden at all.
  20. You can count on one hand the number of fields in Indiana that don’t have a visible play clock, so I can’t see that the expense argument holds any water. And a visible play clock is of great bebfit to the coaches and players ... and the officials, too.
  21. I think there’s a big difference between “homogenized” facilities, and the universal use of aids and devices that make the game better. I love the uniqueness of high school facilities, from a “university style” campus like Carmel or Merrillville, to a game site in the middle of a cornfield like some of the 1A schools, to a lakeside venue like Culver Academy. But every school having a visible play clock has nothing to do with that.
